These Terms of Service (hereinafter referred to as the "Terms") constitute a legally binding agreement between you (hereinafter referred to as "you" or "User") and Fast Eagle Game, a gaming brand operated under THAI BEST BIOTECHNOLOGY CO., LTD. (hereinafter referred to as "we," "us," or "our"). These Terms govern your access to and use of our mini-game (hereinafter referred to as the "Game" or "Service") made available on the TikTok platform. By downloading, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please immediately cease using the Service.

1. Acceptance of Terms

By using the Service, you confirm that you are of legal age to enter into a binding agreement, or that you are a minor using the Service with the explicit consent and supervision of your legal guardian. We reserve the right to update or modify these Terms from time to time. Any changes will be posted within the Service, and your continued use of the Service after the changes are posted constitutes your acceptance of the updated Terms.

2. License to Use the Service

We grant you a personal, non-exclusive, non-transferable, and revocable license to access and use the Service solely for non-commercial entertainment purposes. This license does not include the right to: (a) modify, reverse engineer, decompile, or disassemble the Service or any part thereof; (b) copy, distribute, or share the Service with any third party; (c) use the Service for commercial purposes or in any manner that violates these Terms or applicable laws.

3. Game Account and Guest Mode

The Service supports guest mode for quick access, with no mandatory registration or collection of personally identifiable information. Game data in guest mode is stored locally on your device only. You acknowledge that such data may be lost if you change devices, clear cache, or uninstall the Game, and we shall not be liable for any such data loss.
You are solely responsible for maintaining the security of your access to the Service (including any account you may create). You agree not to share, lend, or trade your access to the Service or any in-game items with any third party. We reserve the right to suspend or terminate your access to the Service if we suspect any unauthorized use or violation of these Terms.

4. User Conduct

You agree to use the Service in compliance with these Terms, applicable laws, and TikTok platform rules. You shall not engage in any of the following prohibited behaviors:
•Use cheats, scripts, automation tools, or exploit game bugs to gain an unfair advantage or manipulate game data;
•Harass, insult, or harm other users, or post illegal, pornographic, violent, politically sensitive, or otherwise inappropriate content;
•Reverse engineer, modify, or tamper with the Service, its code, or any related materials;
•Engage in malicious activities, including but not limited to DDoS attacks, mass account registration, or disrupting the normal operation of the Service;
•Infringe upon our intellectual property rights or the rights of third parties;
•Use the Service in any way that violates TikTok's platform policies or public order and good morals.
We reserve the right to take appropriate action against any User who violates these Terms, including but not limited to issuing warnings, restricting access to certain features, suspending or terminating access to the Service, and deleting related game data. We shall not be liable for any losses incurred by you as a result of such actions.

5. In-Game Items and Virtual Content

All in-game items, virtual currency, rewards, and other virtual content (collectively referred to as "Virtual Items") are part of the Service. Virtual Items are for in-game use only, have no real-world monetary value, and cannot be redeemed for cash, traded, sold, or transferred to any third party. We reserve the right to adjust, modify, or remove Virtual Items at any time without prior notice or compensation.
Any Virtual Items with a limited validity period will expire automatically upon the end of such period. You are responsible for using Virtual Items within their validity period, and we shall not be liable for any loss resulting from expired Virtual Items.

6. Advertising and Third-Party Services

The Service may display third-party advertisements. We are not liable for the content, accuracy, or legality of such advertisements, and any disputes arising from third-party advertisements shall be resolved directly between you and the relevant third party.
We may use third-party analytics and advertising services (including those provided by TikTok and its partners) to improve the Service and deliver relevant advertisements. These third parties may collect certain non-identifiable data in accordance with their own privacy policies, as described in our Privacy Policy.

7. Intellectual Property Rights

All intellectual property rights in and to the Service, including but not limited to game design, graphics, text, audio, video, code, and trademarks, are owned by us or our licensors. You shall not copy, modify, distribute, or use any of these intellectual property rights without our prior written consent. Unauthorized use may result in legal liability.

8. Disclaimer of Liability

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or free of bugs or viruses. We shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Service, including but not limited to data loss, loss of Virtual Items, or disruptions caused by network issues, device malfunctions, or force majeure.
We shall not be liable for any losses resulting from your violation of these Terms, unauthorized use of the Service, or reliance on third-party content or services. We reserve the right to suspend, modify, or terminate the Service at any time, for any reason, without prior notice or compensation.

9. Data Processing and Privacy

We collect, use, and store your information in accordance with our Privacy Policy, which is incorporated into these Terms. We will not sell, rent, or share your personal information with any third party without your consent, except as required by law or as described in the Privacy Policy.

10. Children's Protection

The Service is not intended for users under the age of 13. If you are under 13, you are prohibited from using the Service. We comply with the Children's Online Privacy Protection Act (COPPA) and will not intentionally collect personal information from minors under 13. If we become aware that a minor under 13 has used the Service, we will immediately delete any related data.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Thailand. Any dispute arising out of or in connection with these Terms or the Service shall first be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to the competent court in the jurisdiction where THAI BEST BIOTECHNOLOGY CO., LTD. is located for final resolution.

12. Miscellaneous

If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and us regarding the Service, superseding all prior agreements or understandings.
